Terms of Service

Last updated: March 2026

TrustScan does not provide legal advice. This tool identifies potential dark patterns for informational purposes only. All scan results should be reviewed by qualified legal professionals before making compliance decisions.

1. Service Description

TrustScan is an automated dark pattern compliance scanning service operated by Sovereign Systems Pty Ltd. The service uses artificial intelligence to crawl websites, capture screenshots, and analyse them for potential dark patterns mapped to Australian Consumer Law (ACL) and the Competition and Consumer Amendment (Unfair Trading Practices) Bill 2026.

2. Not Legal Advice

TrustScan is an informational screening tool. Scan results are not legal opinions, compliance certifications, or guarantees of regulatory conformance. Findings are generated by AI models and may contain false positives, false negatives, or misclassifications. You should not rely solely on TrustScan outputs when making legal or compliance decisions. Always consult qualified legal professionals.

3. User Responsibilities

By using TrustScan, you agree that:

  • You will only scan websites that you own, operate, or have explicit permission to scan.
  • You will not use TrustScan to harass, defame, or competitively attack other businesses.
  • You will not attempt to circumvent rate limits, abuse the API, or interfere with the service.
  • You are responsible for how you use and share scan results.

4. Payment Terms

Paid subscriptions are billed monthly or annually via Stripe. You can cancel your subscription at any time through the Stripe customer portal accessible from your dashboard. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods. Free scans are available without payment or account creation.

5. Data Handling

When you run a scan, we store:

  • The URL(s) you submitted for scanning.
  • The scan results (findings, risk score, summary).
  • Your email address (if provided).
  • Your IP address (for rate limiting purposes).

Screenshots captured during scanning are processed in memory and discarded after analysis. They are not stored permanently.

6. Limitation of Liability

TrustScan is provided "as is" without warranty of any kind, express or implied. Sovereign Systems Pty Ltd shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from or related to your use of the service, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses, even if advised of the possibility of such damages. In no event shall our total liability exceed the amount paid by you to us in the twelve (12) months preceding the claim.
